The Peoples Democratic Party (PDP) has dragged Yobe Governor Mai Mala Buni to court.
The party wants his removal for taking up the role of Chairman, All Progressives Congress (APC) Caretaker/Extraordinary Convention Planning Committee (CECPC).
The PDP, in a suit filed at the Federal High Court in Abuja on Thursday, said holding two executive positions violated the constitution.
The party said by serving as APC Chairman, the office of Buni and his deputy governor, Idi Gubana, have become vacant.
The legal action demands that the PDP candidate in the 2019 election, Umar Damagum, and his running mate, Baba Aji, be sworn in.
The PDP, Damagum and Aji are the plaintiffs. Buni, Gubana, the APC, and the Independent National Electoral Commission (INEC) are the defendants.
Buni was appointed the caretaker chairman in June 2020 after the crisis that consumed the National Working Committee (NWC) led by former Edo Governor, Adams Oshiomhole.
In reaction to the suit marked FHC/ABJ/CS/885/2021, the APC condemned PDP’s “misplaced and frivolous court action”.
John Akpan Udoedehe, National Secretary, in a statement said the party is executing a “desperate and poorly-scripted propaganda” to deflect attention from its internal wrangling.
The scribe called the PDP “ignominious rablerousers” who have no locus to take any action on APC affairs.
Udoedehe insisted that the Supreme Court already affirmed the status and legality of the CECPC.
“There are clearly spelt out punitive measures against abuse of court processes. We are confident that the Judiciary will apply these measures fully”, he noted.
